All councils in England must operate mandatory HMO licensing. This applies to properties with 5 or more occupants forming 2 or more separate households, regardless of location. If your property meets these criteria, you must apply for a mandatory HMO licence from Redditch council.
England-wide mandatory scheme under the Housing Act 2004 (as amended by the Licensing of Houses in Multiple Occupation (Mandatory Conditions of Licences) (England) Regulations 2018, in force from 1 October 2018). Applies across the entire Redditch Borough to all HMOs occupied by at least 5 persons from two or more households sharing at least one basic amenity such as a bathroom or kitchen.
Applications are made by downloading the application form from the council's website and submitting by post or email to the Private Sector Housing department. Payment is made separately online via the council's payment portal. Redditch Borough Council is committed to ensuring that all occupiers of HMOs live in safe and healthy homes and routinely inspects all licensed HMOs in accordance with the Housing Health and Safety Rating System (HHSRS). Enforcement action in the first instance is based on advising and educating landlords and occupants. If convicted of failing to licence an HMO, the landlord Tenants or local authorities may be able to apply for a rent repayment order. GOV.UK guidance now refers to up to two years' rent for relevant offences, but eligibility, timing and the final amount depend on the facts and tribunal decision. The private sector housing function is shared with Bromsgrove District Council; joint HMO registers covering both Bromsgrove District and Redditch Borough are published on the Redditch BC website.
