No additional HMO licensing scheme has been adopted by Southend-on-Sea City Council as of March 2026. The council operates only mandatory HMO licensing. A proposed Article 4 Direction to remove permitted development rights for change of use from dwellinghouses (C3) to small HMOs (C4, 3-6 residents) was under consultation with a closing date of 30 September 2025; this would bring all HMOs under planning control but is not an additional licensing scheme.

All councils in England must operate mandatory HMO licensing. This applies to properties with 5 or more occupants forming 2 or more separate households, regardless of location. If your property meets these criteria, you must apply for a mandatory HMO licence from Southend-on-Sea council.
Legal basis: Housing Act 2004. Extended from October 2018 to cover all HMOs of any storey height with 5+ occupants forming 2+ households. Previously only applied to HMOs of 3 or more storeys. Criminal offence to operate without licence; For offences committed on or after 1 May 2026, GOV.UK guidance refers to civil penalties of up to £40,000 for relevant offences, with different treatment for breaches and for offences committed before that date.
