The main gap is the mandatory HMO licence fee amount, which is not published on the council's public-facing website and could not be confirmed from any indexed source. The HMO register PDF URL is extracted from the official council page but could not be directly fetched due to SSL certificate issues on the legacy subdomain. Tendring District Council publishes a partial HMO register online as a PDF titled 'Index of Licences 2026 Online Register of HMO's Current.pdf' (accessible from the HMO page on the council website). This online version excludes personal details of licence holders and managers. The full hard-copy register, which includes all prescribed information under Section 232 of the Housing Act 2004 and The Licensing and Management of Houses in Multiple Occupation and Other Houses (Miscellaneous Provisions) (England) Regulations 2006, is held at the council's offices and can be inspected by appointment. All councils in England must operate mandatory HMO licensing. This applies to properties with 5 or more occupants forming 2 or more separate households, regardless of location. If your property meets these criteria, you must apply for a mandatory HMO licence from Tendring council.
Mandatory licensing for Houses in Multiple Occupation (HMOs) across the entire Tendring district, as required by Part 2 of the Housing Act 2004. Applies to properties occupied by 5 or more persons forming 2 or more separate households who share basic amenities (kitchen, bathroom, or toilet). The 3-storey height requirement was removed nationally from 1 October 2018, expanding the number of HMOs subject to mandatory licensing to include single and two-storey qualifying properties. An Article 4 Direction also applies district-wide (in force since 31 May 2013), requiring planning permission for change of use from Class C3 to Class C4 (HMOs occupied by 3-6 unrelated individuals).
Mandatory HMO licensing commenced nationally in April 2006 under Part 2 of the Housing Act 2004. The 3-storey height requirement was removed from 1 October 2018. HMO Policy 2024 Update is the current governing policy document (next review September 2027). Approximately 30 licensed HMOs on the public register (based on third-party data from AgentHMO). Applications can be submitted via the council's own online form (tendring-self.achieveservice.com) or via the gov.uk national licensing portal. Applications cannot be transferred when a property changes ownership or management - a new licence must be obtained. Exemptions or exclusions: Purpose-built self-contained flats within a block comprising three or more self-contained flats are excluded from mandatory HMO licensing nationally. Standard statutory exemptions under Housing Act 2004 apply. Properties with only 3 or 4 occupants do not require mandatory licensing (though may require additional licensing if a scheme is introduced, which it has not been in Tendring). Properties already subject to a selective licence are also excluded.
