All councils in England must operate mandatory HMO licensing. This applies to properties with 5 or more occupants forming 2 or more separate households, regardless of location. If your property meets these criteria, you must apply for a mandatory HMO licence from Torbay Council.
Mandatory HMO licensing applies across the entire Torbay unitary authority area as required by national legislation under the Housing Act 2004. From 1 October 2018, licensing covers HMOs of any number of storeys (not limited to 3 or more storeys as was previously the case).
